When a worker becomes injured on the job, it can be difficult to fully understand the workers comp process. Though the process is meant to be straightforward, people are often confused about which forms they need to fill out and what information they need to provide. This is why many people are denied when they first apply for benefits. To better understand the process and get the help they need, many people hire a lawyer to help them.

An injured worker needs to inform his boss as soon as possible of his injuries. The workers comp process will not begin until the employer is informed. The employer is then responsible for informing the insurance company that handles its worker’s compensation claims. Soon after they are informed, the insurance company will contact the injured worker to gather information on how the accident occurred.

Many employers require injured workers to go through drug and alcohol testing to be sure these did not play a role in causing the accident to occur. Those who refuse testing or fail will have their claim denied and could be at risk for losing their job.

As a part of the process, the injured worker is required to see a doctor who works for the insurance company. Even if the person has been seen by their own doctor, they are still required to see this doctor. It will be up to this doctor to give information to the insurance company regarding the worker’s diagnosis and prognosis. This will be used to determine whether or not the worker is eligible for benefits and for how long.

Worker’s compensation benefits provide workers with wage replacement and medical benefits until they are able to return to work and no longer need medical treatment for their injury.

Injured workers who feel they are being given the run around can find the help they need with a lawyer. A lawyer can work with the insurance agency and the employer to make sure fair benefits are given. Should an appeal be necessary, the lawyer can file an appeal on behalf of his client so the injured worker can receive the benefits he deserves.
